First Steps to Take in a Workers’ Compensation Claim

June 11, 2015 | Employment Law, Workers’ Compensation

So, you work in New Jersey and were injured on the job. You are losing paychecks and medical costs keep rising, so what do you do? Get into contact with an attorney who can help you file a workers compensation claim. Here are some steps to help you prepare.

1. Get Medical Treatment
When filing a claim for workers’ compensation in NJ the first thing to do is see a doctor. If the injury does not require emergency attention, you need to go to your employer’s authorized clinic or hospital. Otherwise, you will be unable to file the claim. In case of an emergency, an authorization will not matter.

2. Save any Papers
When dealing with the doctor, be sure to inform them that the injury is work-related, as it will help with costs. Along with this, be sure to save everything- from doctor reports to pharmacy receipts and make copies. This makes it easy to keep track of how much your medical expenses cost.

3. Report the Injury
In the state of New Jersey, you have 90 days from the date of your injury to report what happened to your employer. While it is not required in writing, it is a good idea to do it this way. Be sure to include in the note the date and the general time that the injury happened and keep a copy of the report in your files.

Being unable to work due to an injury acquired from work is difficult. But a workers’ compensation can at least provide the peace of mind that your costs are taken care of. If you need any help or you are experiencing challenges in filling out or handling a workers’ compensation claim, contact a licensed attorney immediately.
